Welcome to ServeX. By downloading, installing, or using the ServeX mobile application or website, you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you ("User") and ServeX ("we", "us", or "the Platform").
1. Definitions
- "User" — any individual who uses the Platform to request services.
- "Service Professional" — an independent contractor (plumber, electrician, etc.) registered on the Platform to provide services.
- "Services" — the home repair and maintenance tasks facilitated through the Platform.
2. Eligibility & Account Registration
To use our Services, you must be at least 18 years old and capable of forming a binding contract under the laws of Nepal. You agree to:
- Provide accurate, current, and complete information during registration.
- Verify your mobile number using the OTP mechanism provided.
- Maintain the confidentiality of your account. You are responsible for all activity under your account.
3. Nature of the Platform
ServeX operates as a technology aggregator and marketplace connecting Users with independent Service Professionals. We do not directly employ the Service Professionals. They are independent contractors operating under their own responsibility. While we vet professionals for identity and basic suitability, the Platform acts solely as a facilitator for the transaction between you and the professional.
4. User Obligations & Conduct
As a User, you agree to:
- Provide a safe and appropriate working environment for the Service Professional.
- Treat Service Professionals with respect and dignity. Harassment, abuse, or discrimination will result in immediate account termination and possible legal action.
- Describe the problem accurately so the correct professional is dispatched.
- Ensure a person of legal age (18+) is present at the premises during service delivery.
5. Service Requests & Cancellations
- Booking: A booking is confirmed only when a Service Professional accepts your request in the app.
- Cancellation by User: You may cancel without penalty before the professional is dispatched. Cancellations after the professional has arrived may incur a "Visitation Fee" to compensate for their travel time.
- Cancellation by Platform: We may cancel bookings due to unavailability, force majeure, or safety concerns.
6. Fees & Payments
- Standardized rates: Services are charged based on a standardized rate card. An estimate is shown where possible, but the final cost may vary based on materials used and actual work performed.
- No platform fee: ServeX does not charge Users any platform or subscription fee. We earn a small commission from the professional when you pay them.
- Payment methods: Payment is made upon service completion by cash or a supported digital wallet.
- Material costs: The cost of spare parts or materials (pipes, wires, switches, etc.) is not included in the service fee and is paid directly to the professional or purchased by the User.
7. Limitation of Liability
To the fullest extent permitted by Nepali law:
- Quality of work: We are not directly liable for the workmanship of independent professionals, but we facilitate dispute resolution and may arrange re-service in valid cases.
- Damages: We are not liable for indirect, incidental, or consequential damages resulting from the actions of a Service Professional, except where gross negligence by the Platform is proven.
- Security of valuables: We screen professionals, but we advise Users to secure valuables during service visits.
8. Dispute Resolution
Any dispute arising from these Terms or the Services shall first be addressed amicably through our Customer Support. If unresolved, the dispute shall be settled in accordance with the laws of Nepal, within the jurisdiction of the District Court of Jhapa.
9. Modifications to Terms
We may modify these Terms at any time. Updated Terms will be posted on the app and website. Continued use of the Platform after changes constitutes acceptance of the new Terms.
